As students across New York prepare to head back to the classroom, they will once again be subject to the state's bell-to-bell cellphone restrictions, marking the second school year under the statewide policy.
The cellphone ban requires public school districts, charter schools and Boards of Cooperative Educational Services (BOCES) to prohibit the unsanctioned use of smartphones and other internet-enabled personal devices throughout the entire school day. The restrictions apply from the first bell until dismissal, including during lunch, study hall and passing periods.
What the law requires
According to the official website of New York State, the law is intended to reduce classroom distractions and encourage student engagement. State officials have said the policy is designed
to help improve learning, support students' mental health and increase face-to-face interaction during the school day.
While students are not permitted to use personal internet-enabled devices during school hours, school-issued technology remains available for instructional purposes. Individual districts determine how devices are collected or stored during the day, with many using lockers, secure pouches or other storage systems.
Exceptions and parent communication
The law includes several exceptions. Students may use personal devices when authorized for educational purposes, to address a medical need, as part of an Individualized Education Program (IEP) or 504 Plan, for translation services, or in certain emergency or caregiving situations.
Schools are also required to maintain a way for parents and guardians to contact their children during the school day if necessary. Districts establish their own enforcement procedures, although state law prohibits schools from suspending a student solely for violating the cellphone policy.
As the new school year begins, families are encouraged to review their local district's specific cellphone procedures before classes start, as storage methods and enforcement policies may vary even though the statewide requirements remain the same.
