A woman who abandoned her injured dog near a Yonkers cemetery last year has pleaded guilty but will be spared incarceration.
Anita Martin, 60, pleaded guilty in Westchester County Court on Wednesday, Oct. 14, to a pair of misdemeanors, overdriving, torturing and injuring an animal and animal abandonment, acknowledging that she had neglected and failed to feed her dog, Lucky.

On Nov. 21, 2025, Lucky, was found near Oakland Cemetery, bleeding from a gash to the neck and throat.
Martin, who lived about a half mile away, was arrested in January after she was identified as the woman in surveillancevideo walking the dog a short time before it was abandoned.
She initially faced a felony charge of aggravated animal cruelty that could have landed her in state
prison for up to four years.
Assistant District Attorney Alexander Shapiro said the offer for the misdemeanor plea requires her to serve three years of probation, perform 20 hours of community service and pay $1,618 in restitution, which would go to the Yonkers Animal Hospital where Lucky underwent surgery.
She will also have to be added to a registry of animal abusers.
Martin expressed some confusion when Westchester Judge Melissa Loehr referred to her dog as "Lucky aka Frankie", saying her dog was Lucky, she didn't know a dog named Frankie.
Shapiro explained that it was in fact just one dog, that before rescuers knew the dog's name they decided to call him Frankie.
Loehr scheduled Martin's sentencing for Jan. 13, 2027.
