A registered sex offender from Mount Kisco is facing new federal charges after probation officers found sexually explicit images of boys on a secret phone, including some he allegedly solicited from teenagers in California and Pennsylvania, the U.S. Attorney's Office announced.
Dustin Tompkins, 38, appeared in White Plains federal court on Friday, Sept. 11, charged with sexual exploitation of a child, receipt and distribution of child pornography and committing those crimes while a registered sex offender.
Tompkins was assessed a Level 2 sex offender, moderate risk of re-offending, following a 77-month sentence in federal prison for a 2015 guilty plea to receiving and distributing child pornography.

He was subject to lifetime supervised release
and during a visit to his home on Jan. 30, 2026, a probation officer found a smartphone under Tompkins pillow that he had not been allowed to have. He was detained for the alleged violation of supervised release.
The subsequent search of his phone found sexually explicit images of children and that two days earlier he had created a messaging group with a social media app from which he got 55 files of child pornography.
According to the criminal complaint, in October 2025 Tompkins posed as a 24-year-old woman on another social media app and got a 13-year-old California boy to send him naked images of himself. Two months later, he did the same with a 16-year-old Pennsylvania boy.
“Dustin Tompkins represents every parent’s greatest fear: an adult who allegedly used social media to gain access to children and exploit them for his own sexual gratification," U.S. Attorney Jamie McDonald said in a statement.
Tompkins faces minimum prison terms of 25 years on the exploitation charge and 15 years on the pornography charge. He would also face a mandatory additional 10 years if convicted of either charge because he was already a sex offender.
A lawyer for Tompkins could not immediately be identified.
