A Falls man with a recent history of driving on a suspended license is accused in a hit and run that left two women injured in Newtown Township.
The accident happened Aug. 21 shortly after 5 p.m. at Richboro Road and West Hanover Street near the south entrance of Tyler State Park.
Three women were crossing Richboro Road toward the park when a white Hyundai Elantra with a missing front hub cap struck two of them as they were halfway through the crosswalk, according to a probable cause affidavit. The third woman was not injured.
The women alleged there was no oncoming traffic when they started across the crosswalk and the Hyundai was at a stop sign at the park exit when it turned
left onto Richboro Road striking them.
The driver, identified as Dustin Kind, 38, allegedly got out of his vehicle after the accident was heard saying, “Oh My God,” then got back into the car and drove toward West Hanover Street.
The victims were taken to the hospital where they were treated for injuries to their legs and arms including a broken knee, the affidavit said.
Two witnesses provided police with the SD cards from their dash cameras which captured the accident, the affidavit said. Police were able to identify the vehicle registered to Kind, who has a suspended driver’s license. Kind was also identified as the Hyundai driver in the dash cam video.
When police made contact with Kind they found damage to the hood and front bumper of his Hyundai consistent with the crash; the front right hub cap was also missing, the affidavit said.
Kind, who allegedly admitted he was driving while suspended, allegedly told police he was leaving Tyler State Park and thought he saw the pedestrians wave him on.
In 2024, Falls Township police charged him with driving while suspended, a summary offense. He was found guilty and appealed to Bucks County Common Pleas Court, which upheld the conviction last year, the public docket shows.
More recently, Kind has two open traffic cases in Newtown Township and Upper Makefield where he was charged with driving while suspended or revoked two weeks apart in January, according to the docket.
Kind was arraigned Aug. 26 before District Judge Michael Petrucci on felony charges of accidents involving death or injury and accidents involving death or injury while not licensed and related misdemeanors and summaries including driving while suspended.
He was transferred to Bucks County Correctional Center in lieu of $150,000 bail, and he had no legal representation as of Aug. 29, according to the public docket.
