Fugitive Diamantaire Mehul Choksi has filed an appeal before the Court of Cassation in Antwerp In a statement issued to Times Now, Antwerp public prosecutor said "Last October 30th Mr. CHOKSI the filled
an appeal against the decision of October the 17th". "This appeal is strictly limited to legal merits and will be judged by the Court of Cassation. During this procedure, the execution of the extradition is suspended". Choksi has filed an appeal against the Belgium court of appeals order which had cleared his extradition to India and upheld the arrest in Antwerp this April. On 17th October Indian agencies achieved a big success when a Belgian court gave a ruling in favour of India and allowed his extradition. The court had also said Choksi's trial in Mumbai will not be "unfair". Mehul Choksi and his nephew Nirav Modi are accused of defrauding PNB to the tune of $ 2 billon.Both CBI and ED have filed multiple chargesheets against them. "The documentation provided by the person (Mehul Choksi) concerned is not sufficient to establish in concrete terms that the person concerned personally runs a real, present and serious risk of being subjected to flagrant denial of justice or to torture or inhuman and degrading treatment in the requesting State (India)," the Belgian court had said in its order The court further said and noted Mehul Choksi's claim that Indian authorities had abducted him in Antigua in May 2021 is not supported by any evidence. In 2022 Choksi has also sued the Indian government and "Indian agents" in the London High Court. "The decision of the Commission of Control of Files of Interpol dated 12th October 2022 is in-conclusive and very cautious and worded in a conditional manner" the Belgian court had said. "The person concerned does not dispute that he does not hold Belgian nationality. It is therefore established that Mehul CHOKSI is a foreign national,' the Belgian court had said. In March 2019 UK authorities arrested Nirav Modi and he has been lodged in London prison since then. Nirav's renewed plea seeking stay on extradition to India will come up next month. On 23rd November Westminster Court will hear Nirav's plea. India through CPS has assured Nirav will be lodged in a separate cell in Arthur Road Jail and if extradited there will be no humanrights violation
