A resident of the city has filed a formal complaint with Kalighat Police Station in Kolkata seeking criminal proceedings against Trinamool Congress MP Abhishek Banerjee and the driver of a vehicle in his convoy, alleging dangerous violations of traffic laws. Rajib Sarkar, a resident of Baguiati who describes himself as a social reformer has submitted the seven-page complaint on July 1, 2026 to Kolkata police. He urged police toinitiate immediate legal action against the culprits.According to the complaint, Sarkar obtained a photograph from social media showing few individuals, presumably security personnel, standing on the exterior footboard of a moving black SUV vehicle. The vehicle was part of the convoy of TMC general secretary Abhishek Banerjee,
also the MP from Diamond Harbour Lok Sabha constituency. Sarkar contends that transporting people on the running board of a moving vehicle endangers both the individuals involved and the public, and this act violates multiple provisions of law.In the letter of complaint filed with Kolkata police, the complainant Rajib Sarkar has mentioned that, the act violated several laws which are-- Motor Vehicles Act, 1988: Section 123, which bars carrying persons on the running board, and Section 184, which covers ‘dangerous driving’.- Motor Vehicles (Amendment) Act, 2019: Sections 177, 177A, and 184.- West Bengal Motor Vehicles Rules, 1989: Provisions related to passenger safety.- Bhartiya Nyaya Sanhita, 2023: Sections 281 (rash driving), 125 (act endangering life), 223 (disobedience of order by public servant), and 3(5) (common intention).Complainant has argued that while the MP has ‘Y’ category security cover, the ‘Blue Book’ for VIP security provides no exemption for personnel to hang outside civilian vehicles. He noted that legal exemptions for travel on footboards are restricted to specially modified vehicles used by the President and Prime Minister under the SPG Act, 1988.The complainant has appealed Kalighat Police station to register an FIR against TMC MP Abhishek Banerjee and the driver/owner of vehicle under the Motor Vehicles Act and relevant sections of the BNS. Also, he has requested to conduct an impartial probe and ensure exemplary punishment. Rajib Sarkar has urged to confiscate the vehicle for forensic examination to check for unauthorized structural modifications. The complaint also cites Article 14 of the Constitution, stating that the law must apply equally to all citizens and that such conduct by a public representative sets a “detrimental precedent.” It further mentions that deaths resulting from illegal and hazardous acts may void insurance claims under personal accident and life insurance policies.Source in Kolkata police told Times Now, “the letter of complaint has been received and an inquiry is being carried out”.
