With effect from today, that is December 1, new Chief Justice of India Surya Kant has rolled out new guidelines streamlining the listing of cases for hearing, including automatic listing within two working
days of fresh cases involving personal liberty and which require urgent interim ordersThe reforms, according to CJI Kant has been brought in to do away with the usual long list of mentioning by lawyers every day morning for urgent listing of their fresh cases,which is taking away a lot of the court’s time
WHAT DOES THE CIRCULAR SAY:
1) “Steps have been taken by Hon’ble the Chief Justice of India for streamlining listing of cases with effect from 01/12/2025 . No necessity for the litigants to mention their case/s before the Court for listing as the fresh cases will be listed automatically. Four Circulars have been issued." 2) All fresh cases involving liberty of individuals and where urgent interim orders are sought for, where the case is verified, after curing of defects, will be listed within next two working days.3) In order to ensure expeditious disposal of all bail petitions, advance copy shall have to be served on the concerned Nodal Officer / Standing Counsel for the Respondent – Union of India / State / Union Territory.4) In case of an exceptionally urgent matter relating to anticipatory bail, death penalty, habeas corpus, eviction / dispossession and demolition, which cannot await listing on the scheduled date, the request can be made between 10:00 a.m., to 10:30 a.m. 5) All other categories of fresh cases will be listed automatically as per existing practice.6) The fresh cases will be listed automatically and hitherto there shall be no necessity for the litigants to mention their case/s before the Court for listing. 7) No Senior Counsel shall be permitted oral mentioning before any Court. Young Junior counsel may be encouraged to make oral mentioning. In order to ensure disposal of old Regular Hearing matters, no Letters seeking for adjournment of such cases listed before the Hon’ble Courts will be permitted.
