What's Happening?
A lawsuit against Realtor.com, alleging violations of the Telephone Consumer Protection Act (TCPA), has been dismissed. The lead plaintiff, Priestley Faucett, claimed that Realtor.com, operated by Move
Inc., made unsolicited telemarketing calls to him despite his number being on the national Do Not Call Registry. The case was filed in the US District Court for the Central District of California. However, Judge Otis D. Wright II denied Faucett's motion for class certification in December, leading to a joint stipulation of dismissal filed on January 30, 2026.
Why It's Important?
The dismissal of this lawsuit highlights ongoing challenges in enforcing the TCPA, which aims to protect consumers from unwanted telemarketing calls. The case underscores the difficulties plaintiffs face in achieving class certification, a crucial step for collective legal action. This outcome may influence future TCPA-related lawsuits, potentially discouraging similar claims due to the complexities involved in proving widespread violations. Businesses may view this as a precedent to continue aggressive marketing strategies, while consumer advocates might push for stricter enforcement and clearer regulations.
