Singh and Aditya Dhar's Dhurandhar The Revenge has been on a historic run at the box office since its release, rewriting records with each passing day. However, the all-time blockbuster has now found itself at the centre of a copyright dispute in court. A production house named Trimurti Films has accused Aditya Dhar's banner B62 Studios of unathorised use of a song from one of their older movies and now the matter is with the Delhi High Court.
B62 Studios Accused of Unauthorised Use Of Oye Oye Song
The heart of the dispute lies in a beloved song from the late 1980s. The dispute is regarding the rights to use the popular song from the 1989 film Tridev, originally composed by Kalyanji-Anandji along with Viju Shah, with lyrics by Anand Bakshi and vocals by Amit Kumar and Sapna Mukherjee. The song in question is Tirchi Topiwale, remembered by its iconic hook Oye Oye.Trimurti Films, the original producers of the 1989 film, allege that Dhurandhar 2 used a version substantially similar to this classic in its new track titled Rang De Lal and that this was done without obtaining the necessary licences or permissions from the rightful owners of the musical work.
The new version, Rang De Lal (Oye Oye), has been composed by Shashwat Sachdev with vocals by Jasmine Sandlas, Afsana Khan, Amit Kumar, and Rebel. Despite the recreation carrying new vocals and production, Trimurti Films contends that the underlying musical work still belongs to them and that no permission was sought before using it.Trimurti's grievances extend beyond just the theatrical run. The production house is seeking an immediate injunction to restrain any further use of the song in the film's theatrical run, promotional materials, and upcoming digital releases, while also seeking significant financial damages.The defence side also made arguments before the court. Senior Advocate Akhil Sibal, appearing for Super Cassettes, which holds the audio rights in Dhurandhar 2's songs, opposed any interim relief for Trimurti. He argued that Trimurti had approached the court with unclean hands, alleging that the production house had suppressed prior instances where similar songs from Tridev were used in other films without objection.On the matter of the film's digital release, Senior Advocate Ravi Prakash, appearing for B62 Films, told the court that the film was unlikely to be made available on OTT platforms until mid-May. This timeline gives both sides time to find a resolution.It is also worth noting that this is not the only song from Tridev at issue. Trimurti Films has also filed a separate lawsuit against B62 Studios over the alleged unauthorised use of another Tridev track, Hum Pyar Karne Wale, in Dhurandhar 2, originally sung by Anuradha Paudwal and Udit Narayan.
Delhi High Court Refers Matter to Mediation: What Does This Mean?
Rather than proceeding with a full court hearing immediately, the Delhi High Court took a practical step. Justice Tushar Rao Gedela observed that the controversy appeared to be primarily financial in nature and indicated that the parties could work out a resolution, including issues of royalty and compensation, through mediation. The court also directed that a senior mediator be appointed.
For those unfamiliar with the legal process, mediation is a formal process where both parties in a dispute sit down with a neutral third party, the mediator, to try and arrive at a mutually acceptable settlement. It is not a court ruling, and neither side is declared a winner or a loser.The fact that the court viewed the matter as primarily financial suggests the judge did not see a reason to immediately stop the film's run or the song's use.
