A US appeals court has temporarily declined to halt a Pentagon declaration that labeled Anthropic as a ‘Supply Chain Risk’. This means that for now, the label on the American tech giant will stay in place while the legal dispute between the government and the firm continues. Moreover, a wider government ban on the firm’s technology remains tied up in separate court proceedings. According to Bloomberg, the ruling came on Wednesday by a three-judge panel in Washington, DC, letting the Defense Department’s assessment remain in force as of now. However, the court said that the matter will be reviewed on an urgent basis. Court Acknowledges Anthropic Could Face ‘Irreparable Harm’Rejecting the Anthropic’s request for an immediate ban on the Pentagon’s
decision to label it as a ‘Supply Chain Risk’, the court acknowledged that the AI firm is likely to face serious financial consequences as the case proceeds. The judges' panel highlighted the possibility of “irreparable harm” and scheduled arguments for May 19, 2026, suggesting an expedited review process. The court noted that the technology giant may lose a significant amount of money, but weighed Anthropic’s commercial concerns against the national security considerations tied to the US Department of Defense’s decision. Moreover, the court’s reasoning reflected the border stakes of the legal dispute. It framed the issue as a balance between “a relatively contained risk of financial harm to a single private company” and the government’s authority to manage how critical AI tech is secured during an active military context.
