Arjun has gotten relief from the Delhi High Court. The Pushpa actor's personality rights have been protected by the HC restraining several websites and online platforms from unauthorised commercial use of his name, image and likeness. Justice Tushar Rao Gedela passed an interim order on April 17, stating that the actor has been able to establish ‘a strong case in his favour’. It is indeed a big relief from the Delhi HC for Allu Arjun after he filed a petition to protect his personality rights. For the unversed, many celebrities from Bollywood and the South have already protected their personality rights.
Delhi HC Protects Allu Arjun’s Personality Rights
The
Delhi High Court judge in his order noted that the overwhelming documentary evidence was provided by the plaintiff (Allu Arjun). He has established himself as a successful actor right from the beginning of his career as a child artist in the 1985 film, Vijetha. The court also mentioned the internationally acclaimed film Pushpa and its sequel, Pushpa 2, in the note. The HC also added that his popular dialogues and other distinctive attributes also demonstrate his status. Hence, the things like his name, appearance and voice have clearly constituted copyrights of the Pushpa actor over which he has exclusive rights of exploitation, and he would suffer an irreparable loss and injury if interim relief were not granted. The court has also ordered social media platforms to take down infringing content related to Allu Arjun.
The restrictions imposed by the Delhi HC also have the use of technologies such as artificial intelligence, generative AI, machine learning, deepfakes and face morphing across all physical and digital platforms, including websites, social media and so on. The senior counsel, Swathi Sukumar, had earlier argued that Allu Arjun’s personality traits were being misused through merchandise sales featuring his name, signatures, voice-cloning platforms, AI chatbots, images and even obscene content. Allu Arjun is yet to share an official statement about this on social media. Earlier, actors like Salman Khan, Aishwarya Rai Bachchan, Abhishek Bachchan, Sonakshi Sinha and others have also received interim relief from the high court after approaching it to protect personality rights.
