claims of data theft by Chinese AI labs. Musk posits that Anthropic itself is guilty of large-scale data misappropriation, even pointing to reports of the company utilizing copyrighted literature and publicly available internet data for training its AI models. He stated emphatically on the social platform X that "Anthropic is guilty of stealing training data at massive scale and has had to pay multi-billion dollar settlements for their theft. This is just a fact." This assertion places Anthropic under a critical spotlight, questioning the ethical foundations of their AI development practices amidst ongoing industry-wide debates.
Anthropic's Allegations
Anthropic recently brought forth accusations against several Chinese AI entities, including DeepSeek, MiniMax, and Moonshot AI. According to reports, Anthropic detailed that these companies engaged in extensive, orchestrated efforts to illicitly obtain data from their Claude model. This operation allegedly involved the creation of approximately 24,000 fabricated Claude accounts, which resulted in over 16 million interactions, clearly contravening Anthropic's service terms and geographical usage restrictions. The technique in question is 'distillation,' a common AI development practice where a smaller model learns from the outputs of a larger, more capable one. However, Anthropic contends that its rivals are exploiting this method to rapidly acquire advanced AI capabilities at a significantly reduced cost and timeframe compared to independent development, thus engaging in what Anthropic views as intellectual property theft.
Broader Data Concerns
Musk's pointed remarks against Anthropic emerge during a period of escalating friction between American and Chinese AI developers. While Anthropic asserts that its competitors are pilfering intellectual property, Musk and other prominent figures have highlighted that U.S. companies also face considerable scrutiny regarding their methods for acquiring training data. Last year, Anthropic itself was involved in a significant legal dispute, reportedly settling a $1.5 billion lawsuit brought by authors and publishers who alleged that the company had incorporated copyrighted books into its training datasets without proper authorization.
