The New Regulatory Stance
The Union Ministry of Environment, Forest and Climate Change (MoEFCC) recently informed Parliament that Artificial Intelligence (AI) data centres do not, by themselves, require a standalone Environmental Clearance (EC) under the Environmental Impact Assessment
(EIA) Notification of 2006. Instead of creating a new category for these facilities, their environmental oversight is being folded into existing regulations for construction. This means a data centre project will only need a prior EC if it is part of a larger development that crosses specific size thresholds. This clarification provides a clearer, and potentially faster, regulatory path for a sector seen as critical to India's technological ambitions.
When Is Clearance Still Required?
While standalone data centres are exempt, they are not entirely free from environmental scrutiny. An EC becomes mandatory if the data centre is part of a building and construction project with a built-up area greater than 20,000 square metres. The requirement also applies if the facility is part of a larger township or area development project spanning over 50 hectares or having a built-up area of 1,50,000 square metres or more. In these instances, the clearance must be granted by the State Environment Impact Assessment Authority (SEIAA), which keeps the approval process at the state level.
Fueling India's Digital Growth
The government's decision is a clear signal of its intent to fast-track the development of digital infrastructure. India's data centre capacity has grown exponentially, from 375 MW in 2020 to over 1,500 MW recently, with projections to grow even further. By clarifying that data centres are not a separate industrial category needing a full EIA, the government aims to reduce administrative hurdles and attract more investment. This is part of a broader push to make India a global data centre hub, with cities like Mumbai, Hyderabad, Chennai, and now even Visakhapatnam emerging as key locations for massive investments from global and domestic players.
The Environmental Concerns
Despite their clean, digital facade, data centres have a significant environmental footprint. They are incredibly power-hungry and require vast amounts of water for cooling their servers, which run 24/7. Critics and environmental groups argue that treating these facilities merely as 'buildings' overlooks their unique and substantial resource consumption. Concerns are particularly acute in water-stressed regions where new data centre hubs are being planned. In Visakhapatnam, for example, planned projects have sparked protests from activists who fear the strain on local water and energy resources, as well as ecological damage from construction near sensitive green zones. Experts warn that the clustering of data centres can deplete local groundwater and stress the energy grid.
What Oversight Remains?
The exemption from a standalone EIA does not mean a complete lack of regulation. The government has pointed out that other existing laws will continue to apply. The use and discharge of water are regulated under the Water (Prevention and Control of Pollution) Act, 1974, and air emissions fall under the Air Act of 1981, with State Pollution Control Boards responsible for monitoring compliance. Furthermore, when larger projects containing data centres are assessed for an EC, aspects like freshwater availability, water balance reports, and the recycling of greywater are considered. The government is also promoting efficiency through guidelines that encourage using treated water and adopting energy-efficient cooling technologies.
