What the Government Stated
In a recent parliamentary session, the Union government clarified its position on the rapidly growing AI infrastructure in India. Minister of State for Environment, Kirti Vardhan Singh, stated that AI data centers do not inherently require a separate,
standalone environmental clearance (EC) under the 2006 Environmental Impact Assessment (EIA) Notification. Instead, they will be regulated under existing frameworks. The government's stance is that these facilities are covered by the Water (Prevention and Control of Pollution) Act of 1974 and the Air (Prevention and Control of Pollution) Act of 1981. Essentially, if a data center is part of a large construction project—exceeding thresholds like 20,000 square meters of built-up area—it will need clearance from the State Environment Impact Assessment Authority (SEIAA), just like any other large building. Otherwise, specific AI-focused rules are not on the horizon.
The Digital Brain's Thirst and Hunger
So, why is this a major point of discussion? Because AI facilities are unlike any office building. Data centers are the physical heart of the digital world, housing thousands of powerful servers that run 24/7. These servers generate immense heat and require constant cooling, which is where a staggering environmental footprint emerges. A large data center can consume as much water as a small city, with some using up to 5 million gallons daily for cooling. Their electricity demand is equally astonishing; a single hyperscale AI data center can use as much power as 100,000 homes. India's data center capacity is projected to explode, growing from around 1,500 MW in 2025 to over 13,500 MW by 2031. This rapid expansion means the resource demands will only intensify, putting pressure on already strained water and energy grids, particularly in water-stressed regions where many of these facilities are being built.
Laws from a Different Era
The Air and Water Acts were landmark pieces of legislation, designed in the 1970s and 80s to tackle visible industrial pollution. Their focus was on smokestacks belching pollutants and factories discharging chemical effluents into rivers. The laws empower State Pollution Control Boards (SPCBs) to grant or deny a "Consent to Operate" to industrial plants, setting limits on the types and quantities of pollutants discharged. The core mechanism is regulating direct pollution outputs. However, the environmental impact of a data center is fundamentally different. It's not about chemical discharge but about massive, indirect consumption of public resources like water and electricity. Critics argue that forcing this new-age industry into an old-world regulatory box is like trying to fit a square peg in a round hole. The laws were not designed to assess or manage the systemic strain that a building full of servers places on a region's entire ecosystem of water and power.
The Case for Using Existing Rules
The government's rationale for sticking with the current framework is centered on efficiency and avoiding regulatory bottlenecks. By classifying data centers under 'construction projects' when they meet size thresholds, the approval process is streamlined through existing state-level bodies. Officials have noted that during this process, factors like freshwater availability, water balance reports, and the recycling of greywater are considered before environmental safeguards are prescribed. Proponents of this approach argue that creating a whole new category of regulations for a single industry could stifle investment and slow down India's ambition to become a global AI hub. They contend that as long as the facilities adhere to the discharge and emission standards set by the SPCBs under the Air and Water Acts, they are compliant. The focus, from this perspective, is on ensuring they don't actively pollute, rather than regulating their resource intake.
Are We Future-Proofing or Falling Behind?
The core of the debate is whether this approach is truly sustainable. Environmental advocates and some experts warn that failing to create specific, forward-looking policies for data centers is a missed opportunity that could lead to serious resource conflicts. While a data center may not discharge industrial waste into a river, its consumption of millions of gallons from that same river for cooling has a profound impact, especially in drought-prone areas. Protests have already occurred in places like Visakhapatnam and Thane over concerns about the strain new data centers will place on local resources. The United Nations has also raised alarms, urging transparency and noting that the global environmental footprint of AI is expanding at a pace that could severely strain planetary resources. By not creating a bespoke regulatory framework, critics fear India is prioritizing investment over long-term ecological resilience, potentially locking in unsustainable practices for a fast-growing, permanent industry.
