The Government's Green Light
In a significant clarification, the Ministry of Environment, Forest and Climate Change (MoEFCC) has stated that AI data centres will not be treated as a special category requiring standalone environmental clearance. In a written response to Parliament,
the ministry confirmed that these facilities do not, by themselves, automatically trigger a mandatory Environmental Impact Assessment (EIA) under the EIA Notification of 2006. This decision effectively means that a data centre is not classified as a distinct type of industrial project with its own specific environmental regulations. Instead, it will be governed by existing rules that apply to all large-scale construction. The move provides the booming data centre industry with a clearer, and potentially faster, path to development by avoiding an additional layer of regulatory scrutiny that could have been imposed.
Understanding the Thresholds
So, when does a data centre need clearance? The requirement kicks in when the project crosses the size thresholds defined for general building and construction projects. According to the MoEFCC, a prior environmental clearance is mandatory only if the data centre is part of a construction project with a total built-up area exceeding 20,000 square metres (approximately 215,000 square feet). An even higher threshold applies for large integrated township or area development projects, which need clearance if they cover over 50 hectares or include more than 150,000 square metres of built-up area. If a project meets these criteria, the clearance process is handled at the state level by the State Environment Impact Assessment Authority (SEIAA). Essentially, data centres are being treated like large office complexes or commercial buildings rather than resource-intensive industrial plants.
The Environmental Cost of AI
The debate over this policy hinges on the immense environmental footprint of data centres. These facilities are incredibly thirsty for two resources: electricity and water. They house thousands of power-hungry servers that run 24/7, and require massive cooling systems to prevent overheating. A large data centre can consume as much water as a small town and require an electricity supply equivalent to tens of thousands of homes. The projected growth in India is staggering, with data centre capacity expected to increase dramatically by the early 2030s. This rapid expansion has raised serious concerns about the strain on local power grids and, most critically, on water resources, especially in regions that are already water-stressed. Environmental groups have been pushing for data centres to be classified as a distinct industrial category precisely because their operational impact is far greater than that of a typical building project of the same size.
A Calculated Push for Digital India
From the government's and industry's perspective, this regulatory approach is pragmatic. By not creating a separate, stringent clearance category for data centres, India can accelerate the development of critical digital infrastructure needed to become a global AI hub. Proponents argue that existing laws, such as the Water Act and Air Act, are sufficient to regulate the environmental impact. The ministry has assured that during the appraisal process for large construction projects, factors like freshwater availability, water recycling, and reuse are considered, and necessary environmental safeguards are put in place. This policy is seen as a way to streamline investment and construction in a sector vital for economic growth, removing potential bureaucratic hurdles while relying on established, broader environmental laws to manage the consequences.
Are Existing Rules Enough?
Critics, however, remain skeptical. They argue that lumping data centres into the general construction category fails to address their unique and intense operational demands. The primary concern is that while an individual data centre might be built within the prescribed limits, the cumulative effect of clustering many such facilities in one area—a common industry practice—could overwhelm local resources without a comprehensive regional impact assessment. Environmentalists in areas like Visakhapatnam, which is slated to become a major data centre hub, have protested, demanding that these projects undergo the full scrutiny of an industrial EIA, including public consultations. They fear that the current framework underestimates the long-term ecological stress caused by the massive and continuous consumption of power and water that is unique to these facilities.
