Why the Automatic Pause Happens
When you invest for a minor, the account is held in the child's name, but you, as the parent or guardian, operate it. Since minors cannot legally enter into contracts, the guardian makes all transactional decisions. However, upon turning 18, the child becomes
a legal adult. According to Indian law and SEBI regulations, the guardian's authority over the account ceases immediately. Consequently, the mutual fund house freezes the folio for all future transactions, including SIPs, redemptions, and switches, to prevent unauthorised activity. This is a protective measure to ensure the new adult takes full, legal control of their own investments.
The Key: Shifting from Minor to Major Status
The core of this process is updating the account's status from 'minor' to 'major'. This isn't just a formality; it's a crucial change in legal ownership and operational control. Until this update is completed, the accumulated funds are safe but remain inaccessible. The responsibility for all future investments, and any tax implications, shifts from the guardian to the 18-year-old. While the child was a minor, any gains were clubbed with the guardian's income for tax purposes. After turning 18, they are treated as a separate individual for tax assessments.
A Step-by-Step Guide to Update the Account
To unfreeze the account and resume investing, the new major must follow a specific procedure. While requirements may vary slightly between Asset Management Companies (AMCs), the essential steps are consistent. First, the individual needs to have a PAN card. If they don't have one, this is the first document to apply for. Next, they must complete their Know Your Customer (KYC) process as an adult. This involves submitting their photo, PAN, and proof of address. Finally, you need to submit a specific 'Minor to Major' (MAM) conversion form to the AMC or its Registrar and Transfer Agent (RTA). This form must be signed by the new adult, with their signature attested by the guardian, a notary, or their bank.
Documents You Will Need
Gathering the right documents in advance will make the process smoother. You will typically need to submit the completed Minor to Major (MAM) form, a copy of the new major's PAN card, and proof of their completed KYC. Additionally, you must provide updated bank account details in the new adult's name. This is often verified with a cancelled cheque that has their name pre-printed, or a recent bank statement. A fresh nomination form is also required. Once these documents are processed and the folio status is updated, the freeze is lifted.
Restarting the SIP and What's Next
With the account status officially changed to 'major', the old SIP mandate linked to the guardian's bank account becomes invalid. To continue investing systematically, a new SIP mandate must be registered. This new mandate must be linked to the 18-year-old's personal bank account. This transition is an excellent opportunity for financial education. It marks the moment a young adult gains full control over a significant financial asset. Parents can use this as a practical lesson in managing investments, understanding compounding, and planning for long-term financial goals, empowering their child to take charge of their financial future.
