What the Agreement Entails
On July 22, 2026, the United States and Saudi Arabia signed a Section 123 Agreement, the legal framework required for transferring American nuclear technology and materials. This multi-billion dollar, 30-year partnership is designed to allow U.S. firms
to help build Saudi Arabia's planned nuclear power infrastructure. The Kingdom intends to construct several large nuclear power plants, as well as smaller modular reactors, to meet its growing electricity needs. However, the deal has generated significant controversy because it does not include the so-called "gold standard" of non-proliferation, which would require Riyadh to renounce uranium enrichment and reprocessing. It also does not mandate that Saudi Arabia adopt the International Atomic Energy Agency's (IAEA) Additional Protocol, a more intrusive inspections regime.
Riyadh’s Strategic Motivations
Saudi Arabia's push for nuclear power is a cornerstone of its ambitious Vision 2030 plan, which aims to diversify the country's economy away from oil. Generating electricity from nuclear reactors would free up vast quantities of crude oil, which are currently burned for domestic power, for more lucrative export markets. The Kingdom has stated its goal is to develop the entire nuclear fuel cycle, from uranium mining to fuel manufacturing, for both domestic use and export. Beyond economics, the ambition is deeply tied to regional geopolitics. With Iran's advanced nuclear program, Saudi officials have publicly stated they would pursue a nuclear weapon if Tehran were to develop one, making any domestic nuclear capability a strategic hedge.
Washington's Calculated Risk
For the United States, the agreement represents a strategic calculation to maintain influence in a critical region and counter the growing presence of China and Russia, who are also contenders for building Saudi Arabia's reactors. By partnering with Riyadh, Washington can retain oversight of the program and embed U.S. safety and non-proliferation norms, an opportunity that would be lost if the Kingdom turned to other suppliers. The deal is also seen as a way to solidify the long-term strategic alignment between the two nations at a time when Riyadh has expressed doubts about American security commitments. Supporters argue it benefits American industry and strengthens a key ally, while critics see it as a dangerous departure from decades of non-proliferation policy.
The Proliferation Controversy
The central debate revolves around the risk of nuclear proliferation. Unlike a similar 2009 deal with the United Arab Emirates, where the UAE voluntarily renounced enrichment, the Saudi agreement keeps that option on the table. While the immediate plan involves a two-year joint study on the feasibility of an enrichment facility, the concession has alarmed arms control advocates and members of the U.S. Congress. Critics argue that providing a pathway to enrichment for a nation that has openly discussed developing nuclear weapons creates a dangerous precedent and could ignite a regional arms race. The deal must still be reviewed by Congress, where it is expected to face significant scrutiny over these very concerns.
An Uncertain Path Forward
The agreement's future is further complicated by shifting political dynamics. After the deal was signed, President Trump suggested its final implementation could be contingent on Saudi Arabia normalizing relations with Israel by joining the Abraham Accords, a condition that was previously dropped. This has introduced a new layer of uncertainty, testing the reliability of the U.S. as a partner. Meanwhile, the deal is proceeding to a 90-day congressional review period, where lawmakers can pass a joint resolution of disapproval. The outcome of this process will not only determine the future of U.S.-Saudi nuclear cooperation but could also redefine non-proliferation standards for decades to come.
