The Big Picture: A Moratorium for Younger Students
The centerpiece of the new policy is a one-year moratorium on student-facing generative AI for all children in grades 2K through eighth grade. This decision, affecting nearly 600,000 students, is based on the belief that younger learners need more hands-on
learning, social interaction, and direct teacher guidance. The rules reflect feedback from a public engagement process and a desire to prioritize human instruction over technology, especially for developing minds. The move represents one of the most significant stances against unregulated AI use in schools in the country. The policy also includes recommendations to limit daily screen time, suggesting no more than 30 minutes for grades 3-5 and 45 minutes for grades 6-8.
High School: Guided Use and AI Literacy
The approach for high school students is different. Instead of a ban, the rules focus on limited and guided use to prepare students for a world increasingly shaped by AI. All high schoolers will be required to take two 45-minute AI literacy modules covering how the technology works, its biases, data privacy risks, and ethical considerations. The goal is to build critical thinking skills before students begin to rely on these tools. Use of generative AI will be restricted to approved and vetted programs for specific purposes, such as career-readiness pathways and limited pilot programs in a small number of classrooms. Even then, these tools must be approved through a rigorous data privacy and security review process.
Protecting Student Data and Privacy
A major driver of the new regulations is the protection of student data. The guidelines state that student data can never be used to train commercial AI models or be monetized, in accordance with state and federal privacy laws like New York State Education Law Section 2-d and FERPA. Before any AI tool is approved for use, it must undergo a strict evaluation by multiple city and school district offices to check its data storage, security architecture, and compliance with privacy policies. Concerns from parent groups about the potential for AI products to mine student data were a significant factor in shaping this cautious approach. The rules also explicitly ban AI from being used for high-stakes, human-critical functions like grading, student discipline, academic placement, or developing special education plans.
What About Teachers?
While the new rules are largely focused on student use, they also provide clarity for educators. Teachers will still be permitted to use approved AI tools for instructional and operational tasks, such as lesson planning, creating materials, and drafting communications to families. However, they are strictly forbidden from using AI for grading or behavior monitoring. The district is also providing professional development opportunities to help educators understand AI, its ethical implications, and how to integrate it responsibly into their teaching. The focus is on ensuring that technology serves as a support for educators, not a replacement for their professional judgment and the crucial teacher-student relationship.
What Comes Next?
This policy is being implemented for the 2026-2027 school year, but it's not set in stone. The city is establishing a Technology in Schools Coalition—comprising students, parents, educators, and experts—to assess the impact of the moratorium and the limited high school pilots. This group will publish a report with recommendations for future school years, indicating that the district views this as an evolving conversation. The move comes after a previous, more lenient framework was met with backlash from parents and teachers in the spring of 2026, prompting the district to take a more cautious and deliberate approach. The policies of the nation's largest school district are being closely watched and could serve as a model for other districts across the country grappling with the same challenges.
