What is an Environmental Impact Assessment?
Think of an Environmental Impact Assessment (EIA) as a mandatory environmental health check-up for a new project. Governed by the Environment Protection Act, 1986, the EIA process is a tool used to evaluate the potential environmental consequences of a proposed
development before it gets the green light. The goal is to predict and mitigate adverse impacts on air, water, land, and local communities, ensuring that development is sustainable. The Ministry of Environment, Forest and Climate Change (MoEFCC) at the central level and State Environment Impact Assessment Authorities (SEIAA) at the state level are the key bodies that grant this approval, known as an Environmental Clearance (EC).
The Real Triggers: Size and Sector Matter Most
So, if not energy consumption, what does trigger an EIA? The primary criteria are the project's scale, location, and the industrial sector it belongs to. The EIA Notification, 2006, which remains the principal regulation, lists various categories of projects that require an EC. These include large-scale undertakings like mining, thermal power plants, major highways, ports, and large construction or township projects. Projects are classified into Category A (appraised at the national level) and Category B (appraised at the state level) based on their size and potential impact. For instance, a building project requires clearance only if its built-up area exceeds 20,000 square meters. Similarly, the threshold for mining projects is based on hectares, not the energy used to extract minerals.
Where Energy Fits into the Puzzle
While not a standalone trigger, energy consumption is a significant factor within the assessment process itself, especially for buildings and townships. The draft EIA Notification of 2020, though controversial and not fully implemented in its original form, highlighted the growing importance of energy efficiency. For building projects under review, compliance with the Energy Conservation Building Code (ECBC) and the use of passive solar design, LED lighting, and solar water heaters are often mandated as part of the clearance conditions. The idea is not to use energy consumption as the initial filter for an EIA, but rather to use the EIA process to enforce energy efficiency standards on projects that are already subject to review due to their size or type.
The Logic Behind the Rules
The rationale for not using energy use as a primary trigger is partly pragmatic. The regulatory framework focuses on more direct and tangible metrics like physical footprint, investment cost, production capacity, or the specific nature of industrial pollutants. These are easier to define as clear-cut thresholds. A trigger based purely on projected energy use could be complex to verify and might not correlate directly with the scale of environmental harm. A small, data-intensive tech park might consume significant energy but have a much smaller ecological footprint than a medium-sized chemical plant with lower energy needs but higher pollution risk. The system is designed to catch projects with the highest potential for broad environmental disruption based on established industrial categories.
A Contentious Point in a Broader Debate
The entire framework of environmental clearances in India has been a subject of intense debate. The proposed 2020 draft notification drew widespread criticism for allegedly diluting environmental protections in favour of 'ease of doing business'. Critics argued that provisions like allowing for post-facto clearance (legalising projects that started without permission) and reducing the scope for public consultation weakened the entire process. While the headline rule about energy use is a specific regulatory detail, it exists within this larger context. For now, the focus remains on project type and scale, making them the gatekeepers for environmental scrutiny, rather than a single metric like energy consumption.
