Delhi BMW Accident: Gaganpreet Kaur, the accused woman who was driving the BMW car, which hit and killed a Finance Ministry official in the national capital on Sunday, will remain in judicial custody till September 27 as the Patiala House Court denied her bail application.
While appearing for the accused in Patiala House Court seeking bail in the case, Advocate Ramesh Gupta argued that what was a mere accident case has been converted into a culpable homicide case. “When the investigating officer registered the case, he was of the view that the accused was driving in a rash and negligent manner,” the lawyer told the court.

He further claimed that
a DTC bus that collided with the two-wheeler and an ambulance that reportedly passed by should also be made an accused in the case.
“An ambulance had stopped but refused to take them. Even he is guilty then. Police said that after the crash, the bike hit the DTC bus. Why did the police not seize the bus? Why did it file the case after 10 hours? The police are under immense pressure, so they can do anything. We pray that the Deputy Commissioner of Police be made witness in the case,” he said.
Requesting bail for Gaganpreet, her lawyer argued that the prosecution’s claim that bail cannot be granted in cases with a potential sentence of up to life in prison is incorrect. The lawyer stated that under certain circumstances, a woman may even be granted bail in cases where the punishment is the death penalty.
The accused’s lawyer said that “if it’s a lady, you can give bail in cases of death sentence and life also”.
What Police Told Court?
Meanwhile, the Delhi Police told the court that Gaganpreet was fully aware of how critical every minute is in accident cases, yet chose to ignore advice to take the victim to the closest hospital. “This was a deliberate attempt,” police submitted, adding that the decision risked the victim’s survival.

In court, the victim described the crash’s severity, stating: “Imagine the speed of the vehicle that it turned upside down.”
What Her Husband Told Police?
Meanwhile, Gaganpreet’s husband, Parikshit Makkar, who was brought to the police station for questioning after being discharged from the hospital on Tuesday, told the police that he had no idea how the accident happened and the tragedy unfolded.
According to Parikshit, Gaganpreet said she was taking the victim to the hospital. Parikshit then told his father-in-law about his wife bringing the injured to his hospital. Parikshit himself took a taxi and left for the hospital, according to Delhi Police.
