Delhi High Court restrains VRS Allcargo from using mark similar to Allcargo

The Delhi High Court has granted interim relief to Allcargo Logistics Limited in a trademark dispute, restraining a rival firm from using the mark “VRS ALLCARGO” and other deceptively similar variations,

Bar & Bench reported. The order was passed in the matter of Allcargo Logistics vs VRS All Cargo Packers and Movers Private Limited.

Justice Tejas Karia, in an order dated December 1, held that the defendants’ adoption of “VRS ALLCARGO” prima facie infringed Allcargo’s long-standing and registered trademarks and unfairly sought to capitalise on the goodwill of the ALLCARGO brand. The Court noted that such use is likely to cause confusion among consumers and amounts to trademark infringement and passing off.

Finding that Allcargo had made out a prima facie case and that the balance of convenience favoured the plaintiff, the Court directed the defendants, their affiliates, and agents to immediately cease using the marks “VRS ALLCARGO” or any other trademark, trade name, or expression deceptively similar to ALLCARGO in connection with logistics services, Bar & Bench reported.

The Court also instructed the domain name registrant to suspend and block the websites www.vrsallcargopackers.com, www.vrsallcargopackers.in, and www.vrsallcargo.in within 24 hours of receiving the order. The next hearing in the matter is scheduled for March 17, 2026.

Allcargo had approached the Court after VRS All Cargo Packers and Movers began offering logistics and relocation services under the marks “VRS ALLCARGO” and similar names, including online platforms. Allcargo, which has used the mark since the early 1990s and holds multiple trademark registrations, argued that the defendants’ services overlapped with its own offerings and were being promoted through the same trade channels.

The Court observed that the defendants remained unrepresented despite service and that the impugned marks were “visually, phonetically, structurally and deceptively similar” to Allcargo’s registered marks.
