A coalition of 10 Lowell residents has filed a lawsuit in Middlesex Superior Court against the Massachusetts Department of Environmental Protection (MassDEP) and Markley Group LLC. The 94-page filing challenges MassDEP's decision to authorize Markley Group's
operation of 27 industrial diesel backup generators and 16 cooling towers in a densely populated residential area. The lawsuit alleges that this authorization occurred prior to final plan approval and describes the process as a 'flawed air quality plan.' Jeff Markley, CEO of Markley Group, expressed concern that such opposition could hinder Massachusetts' competitiveness in the global economy, stating that companies might choose other states like Virginia or Texas for their data center needs. He emphasized that Markley Lowell is a colocation data center, distinct from hyperscale facilities that serve single large clients and consume vast resources. Markley Group has invested at least $650 million in its Lowell facility since purchasing the former Prince Pasta plant in 2015, and serves over 500 clients in Massachusetts, including universities and the Massachusetts State Lottery Commission.
