NATO has made significant strides in developing the technical infrastructure for autonomous systems across its member states, achieving interoperability where allied machines can operate as one. However, a critical challenge remains unresolved: the lack
of a common policy regarding the authority for lethal actions executed by autonomous systems at machine speed. When two allies, operating the same autonomous kill chain, possess different national thresholds for permitting a lethal action, it is unclear whose threshold governs and who is accountable in cases of disagreement. This issue is not hypothetical, as the divergence in policies is evident; for instance, Germany's 2021 coalition agreement rejects lethal autonomous weapon systems without full human control, while the United States' Department of Defense Directive 3000.09 permits such systems with 'appropriate levels of human judgment.' The alliance currently standardizes the machines but not the authority, meaning that while systems can exchange data, the rules for using force cannot be exercised uniformly at machine speed, creating a gap in accountability.

This policy gap in NATO's approach to autonomous systems carries significant implications for U.S. defense strategy and international alliances. The absence of a unified authority framework could lead to unintended escalations or actions that contradict the policies of individual member states, potentially undermining alliance cohesion. If a shared autonomous system acts based on a more permissive threshold of one member, it could commit the entire coalition to consequences that more cautious members never authorized. This could strain diplomatic relations, erode trust among allies, and complicate joint military operations. For the U.S., a leading developer and deployer of advanced military technology, ensuring that its autonomous systems operate within a clear and agreed-upon ethical and legal framework across NATO is crucial for maintaining its leadership role and the credibility of its alliances. The issue highlights the need for robust governance structures to match technological advancements in defense, impacting future military doctrine, procurement, and international arms control efforts.
What's Next?
To address this critical gap, three commitments are proposed without requiring new institutions. First, each participating state should declare its authority threshold for autonomous lethal action in a machine-readable format before fielding a shared interoperable capability. The shared system should then default to the most restrictive declared threshold, ensuring that the alliance operates at the level of its most cautious member. Second, every engagement by an autonomous system should generate an authority record, logging which threshold was applied and under whose authority the action was taken. This would provide clear accountability. Third, threshold disagreements should be treated as a planning input rather than an operational surprise, with coalition exercises rehearsing scenarios where allied authorities do not align. NATO's existing standardization machinery, which certifies technical interoperability, could be extended to certify authority interoperability, making declared thresholds, authority records, and rehearsed disagreement procedures a condition for fielding on allied networks. These steps aim to establish a governance framework that matches the speed and complexity of autonomous warfare.
