What's Happening?
The Florida Bar is advancing towards establishing a certification for expertise in insurance coverage law. This initiative, which has been in development since 2018, aims to distinguish attorneys who specialize in insurance matters from those with less
focused experience. The proposed certification requires candidates to have at least five years of legal practice, with 40% of their work in insurance coverage law, and to have completed at least 30 insurance-related services. Additionally, applicants must pass an examination to demonstrate their proficiency. The Florida Bar's Board of Governors approved the proposed rules in September, and the comment period has recently closed. The next step involves a review by the state Supreme Court. If approved, this certification will be one of 28 offered by the Florida Bar. To further educate attorneys, a Florida Insurance Coverage College seminar is scheduled for March 5 in Orlando, covering recent legislative changes and emerging trends.
Why It's Important?
The introduction of a certification in insurance coverage law is significant as it aims to enhance the quality and specialization of legal services in Florida. By setting a standard for expertise, the certification could improve client trust and ensure that legal practitioners are well-equipped to handle complex insurance cases. This move could also influence the legal market by encouraging more attorneys to specialize in insurance law, potentially leading to more competitive and informed legal representation. For clients, this means access to attorneys with verified expertise, which could lead to better outcomes in insurance disputes. The educational initiatives accompanying the certification, such as the Florida Insurance Coverage College, further support the development of specialized knowledge in this evolving field.
What's Next?
The Florida Supreme Court's review of the proposed certification rules is the next critical step. If approved, the certification process will be implemented, and attorneys will begin applying for this new credential. The upcoming Florida Insurance Coverage College seminar will provide an opportunity for legal professionals to gain insights into the latest developments in insurance law, preparing them for the certification process. The legal community, including judges and attorneys, will likely monitor the impact of this certification on legal practice and client outcomes. Additionally, other states may observe Florida's approach as a potential model for enhancing legal specialization in insurance law.
