The Nscale data center site is located just four feet from the homeowner's property line. In July, the West Virginia Department of Environmental Protection (WVDEP) cited Nscale for violating its stormwater permit, which led to the installation of a flood protection fence. However, the family stated that this fence broke during the recent flooding, allowing water to enter their yard. Nscale acknowledged that water from their Monarch Compute Campus reached a neighboring property due to extreme rainfall, but stated no water entered the home and no cleanup was needed. The WVDEP is currently investigating the incident and assessing the site's stormwater controls.
