California regulators have released a long-awaited plan to modify the governance of water pumping from the Sacramento-San Joaquin River Delta. This proposal aims to offer water agencies more flexibility in adhering to regulations. The Delta serves as the central
hub for California's water system, supplying nearly 30 million people and 4 million acres of farmland. However, this heavy reliance has led to environmental degradation and a decline in native fish populations. Eric Oppenheimer, executive director of the State Water Resources Control Board, stated that a new approach is needed to balance ecosystem needs with human water demands. The draft Bay-Delta plan, released on a Wednesday, introduces an innovative approach that combines voluntary actions with a strong regulatory framework to protect the Sacramento River, the Delta, and San Francisco Bay. This plan, similar to a previous draft from December, is contentious, with environmental advocates arguing it would deprive the Delta of essential water and endanger already declining fish species.

The new Delta water plan is significant due to its potential impact on California's water management, environmental conservation, and agricultural and urban water supplies. The plan offers two compliance pathways for water agencies: either limiting pumping to maintain minimum river and estuary water levels, as traditionally done, or participating in 'voluntary agreements.' These agreements involve agencies committing to specific river flows for environmental protection and contributing funds for habitat restoration projects for fish and wildlife in the Delta. This approach, known as the Healthy Rivers and Landscapes program, is supported by Governor Gavin Newsom and various water agencies serving farms and cities. Stephen Pang, state relations advocate for the Assn. of California Water Agencies, views it as a collaborative and holistic method for ecosystem restoration. However, environmental groups like Friends of the River, represented by Gary Bobker, criticize the plan, asserting it would allow large water suppliers to extract excessive water from the Delta, leading to disastrous consequences for threatened and endangered fish species such as salmon and Delta smelt. They advocate for more stringent flow requirements to aid fish recovery.
What's Next?
The State Water Resources Control Board is scheduled to adopt the plan in October. If adopted, water agencies will have the option to comply through traditional pumping limits or by entering into voluntary agreements under the Healthy Rivers and Landscapes program. Participating agencies have already agreed to initiate collaborative efforts for wetland restoration and a science program to guide these endeavors, with commitments totaling $2.9 billion, largely for aquatic habitat restoration. State officials maintain that if the collaborative approach fails or an agency defaults on its commitments, traditional regulations can still be enforced. However, environmental advocates are expected to continue their opposition, arguing that the voluntary deals favor water agencies' business-as-usual operations at the expense of the ecosystem. The update to the Bay-Delta plan has been in development for years, with the last substantial changes to much of the watershed dating back to 1995 and new rules for the San Joaquin River introduced in 2018. The current update will establish rules for the Sacramento River and the remainder of the Delta.
