What's Happening?
KRA Consultancy Ltd, a Manchester-based company, has been fined £300,000 by the Information Commissioner's Office (ICO) for sending 5,575,715 unsolicited marketing texts between April 2022 and May 2025. These texts targeted individuals already in financial
distress, promoting debt solutions and including fake bailiff threats. The ICO's investigation revealed that the company used high-pressure tactics, leading to over 60,000 complaints. The messages were sent using the sender ID 'DEMAND' and were designed to frighten recipients into engaging with the company's services. Internal communications showed the company's director, Khuram Rezvan Ahmad, referring to these threats as 'coaching'. Despite search warrants and ongoing investigations, KRA continued its unlawful activities, resulting in additional complaints.
Why It's Important?
This case highlights the severe impact of unlawful marketing practices on vulnerable individuals. The significant fine imposed on KRA Consultancy serves as a warning to other companies engaging in similar activities. The ICO's action underscores the importance of protecting consumers from exploitative practices, especially those already facing financial difficulties. The case also emphasizes the need for companies to adhere to legal standards regarding marketing communications, ensuring that consent is obtained before sending messages. The fine reflects the ICO's commitment to enforcing regulations and protecting the public from nuisance marketing.
What's Next?
Following the fine, KRA Consultancy has been ordered to cease sending marketing messages without consent within 30 days. The ICO's enforcement notice aims to prevent further unlawful activities by the company. This case may prompt other companies to review their marketing practices to ensure compliance with regulations. The ICO is likely to continue monitoring similar cases and may increase penalties for non-compliance. Consumers are encouraged to report unwanted marketing texts to help the ICO identify and take action against violators.
