Delhi’s Rouse Avenue Court on Friday discharged former Chief Minister Arvind Kejriwal, former Deputy Chief Minister Manish Sisodia and all other accused in the Central Bureau of Investigation (CBI) case

linked to the alleged Delhi Excise Policy scam, observing that the agency failed to present material sufficient to proceed against them.

The order was passed by Special Judge Jitender Singh, who refused to frame charges in the corruption case and discharged all 23 accused persons.

\n\n

COURT FINDS NO EVIDENCE AGAINST ACCUSED

The court held that no prima facie case was made out against the accused and noted significant shortcomings in the prosecution’s case.

The judge observed that Arvind Kejriwal had been implicated without any cogent material connecting him to the alleged offence.

\n\n

The court emphasised that a fair investigation is fundamental to ensuring a fair trial and found that the evidence placed on record did not substantiate the allegations levelled by the CBI.

The judge also said the voluminous chargesheet filed by the agency contained several lacunae and was not supported by witness statements or corroborative material.

As reported by Live Law, the judge held that the CBI failed to make out even a prima facie case against Sisodia, leading to his discharge from the matter along with the other accused.

The order came after the Rouse Avenue Court had reserved its decision on February 12, following detailed arguments from both the CBI and the accused.

The case relates to alleged irregularities in the now-scrapped Delhi Excise Policy.

The CBI had alleged that a “south lobby” paid around Rs 100 crore to influence the policy in its favour.

The agency filed its first chargesheet in 2022 and later submitted multiple supplementary chargesheets naming 23 accused, including Kejriwal and Sisodia.

During arguments, the CBI maintained that the offence of criminal conspiracy should be viewed in its entirety and argued that the adequacy of evidence should be tested during trial proceedings.

The defence, however, contended that there was no incriminating material linking the accused to the alleged conspiracy.
