New Delhi: Chief Justice of India (CJI) Surya Kant on Wednesday took strong objection to the portions of the new NCERT Class 8 textbook which refer to “corruption

in judiciary”.

CJI Surya Kant pointed out that he would not permit anyone to defame or denigrate the institution and will take necessary action.

As per an Indian Express report published on Tuesday, the new NCERT Class 8 textbook on social sciences mentioned “corruption in judiciary” and “massive backlogs” as major challenges.

On Wednesday, Senior Advocates Kapil Sibal, accompanied by Dr Abhishek Manu Singhvi, flagged the issue before the CJI. “We are deeply disturbed, Class 8 students being taught that judiciary is corrupt,” Sibal pointed out.

Sibal said: “NCERT is teaching class 8 students about judicial corruption. This is a matter of grave concern. We are here for the bar.”

Senior Advocate AM Singhvi said: “The selectivity, my lord. The selectivity.. it is there in other areas also but judicial corruption!”

What did the CJI say

CJI Surya Kant said: “Please wait for a few days. Bar and Bench all are perturbed. All HC judges are perturbed. I will take up the matter suo motu. I will not allow anybody to defame the institution. Law will take its course.”

“As head of the institution, I have done my duty and I have taken cognizance. This seems to be a calculated measure… I won’t say much…”

What did the chapter say

The chapter listed “corruption at various levels of the judiciary” and “massive backlog…on account of multiple reasons, such as a lack of an adequate number of judges, complicated legal procedures, and poor infrastructure” as one of the many “challenges” that the judicial system was reeling under.

The chapter in the new book mentions the approximate number of pending cases in the Supreme Court (81,000), High Courts (62,40,000), and District and Subordinate Courts (4,70,00,000).

The chapter on “corruption in the judiciary” in the new book points out that judges are ruled by a code of conduct that governs not just their conduct in the courtroom but also their behaviour outside the court. It notes the judiciary’s internal mechanism to maintain accountability, and an “established procedure for receiving complaints through the Centralised Public Grievance Redress and Monitoring System (CPGRAMS)”.
